A joint resolution providing for congressional disapproval under chapter 8 of title 5, United States Code, of the rule submitted by the Bureau of Consumer Financial Protection relating to the withdrawal of the rule relating to "Consumer Financial Protection Circular 2023-01: Unlawful Negative Option Marketing Practices".
Providing for congressional disapproval under chapter 8 of title 5, United States Code, of the rule submitted by the Bureau of Consumer Financial Protection relating to the withdrawal of the rule relating to ``Consumer Financial Protection Circular 2023-01: Unlawful Negative Option Marketing Practices''.
Summary
This joint resolution expresses congressional disapproval of a Bureau of Consumer Financial Protection rule that would withdraw a prior rule on unlawful negative option marketing practices. Negative option marketing involves enrolling consumers in billing programs where they are charged on an ongoing basis, such as with subscription services or recurring charges. The original rule, issued in 2023, was designed to require clear disclosure and obtain affirmative consumer consent for such practices. If this joint resolution is approved by both chambers of Congress, the CFPB's withdrawal of this rule would have no legal effect, and the consumer protection rule would remain in place. The joint resolution uses the Congressional Review Act process, which allows Congress to overturn executive branch regulations.
