A BILL
To increase penalties for the sexual exploitation of children.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the “Millstone Act”.
SEC. 2. INCREASED PENALTIES.
(a) Female Genital Mutilation.—Section 116(a) of title 18, United States Code, is amended by striking “imprisoned not more than 10 years” and inserting “punished by death or imprisonment for any term of years or for life,”.
(b) Civil Rights Offenses Involving Sexual Misconduct.—Section 250(b) of title 18, United States Code, is amended—
(1) in paragraph (1), by striking “fined under this title and imprisoned for any term of years or for life” and inserting “fined under this title, punished by death or imprisonment for any term of years or for life”;
(2) in paragraph (2), by striking “fined under this title and imprisoned for any term of years or for life” and inserting “fined under this title, punished by death or imprisonment for any term of years or for life”;
(3) in paragraph (4)—
(A) in subparagraph (A), by striking “fined under this title and imprisoned for not more than 10 years” and inserting “fined under this title, punished by death or imprisonment for any term of years or for life”;
(B) in subparagraph (B), by striking “imprisoned for not more than 30 years” and inserting “punished by death or imprisonment for any term of years or for life”.
(c) Sex Trafficking of Children.—Section 1591(b) of title 18, United States Code, is amended—
(1) in paragraph (1), by inserting “death or” before “imprisonment for any term of years”; and
(2) in paragraph (2), by inserting “death or” before “imprisonment”.
(d) Sexual Abuse of a Minor.—Section 2243(a) of title 18, United States Code, is amended in the continuation text following paragraph
(2), by striking “shall be fined under this title, imprisoned not more than 15 years, or both” and inserting “shall be fined under this title, punished by death or imprisonment for any term of years or for life, or both”;
(e) Abusive Sexual Contact.—Section 2244(c) of title 18, United States Code, is amended by striking “maximum term of imprisonment that may be imposed for the offense shall be twice that otherwise provided in this section.” and inserting “punishment shall be death or imprisonment for any term of years or for life.”.
(f) Sexual Exploitation of Children.—Section 2251(e) of title 18, United States Code, is amended to read as follows:
“(e) Any individual who violates, or attempts or conspires to violate, this section shall be fined under this title and punished by death or imprisonment for any term of years or for life.”.
(g) Selling or Buying of Children.—Section 2251A of title 18, United States Code, is amended—
(1) in subsection (a), by striking “shall be punished by imprisonment for not less than 30 years or for life and by a fine under this title” and inserting “shall be punished by death or imprisonment for not less than 30 years or for life and by a fine under this title”; and
(2) in subsection (b), by striking “shall be punished by imprisonment for not less than 30 years or for life and by a fine under this title” and inserting “shall be punished by death or imprisonment for not less than 30 years or for life and by a fine under this title”.
(h) Material Involving the Sexual Exploitation of Minors.—Section 2252(b) of title 18, United States Code, is amended to read as follows:
“(b) Whoever violates, or attempts or conspires to violate, subsection (a) shall be fined under this title and punished by death or imprisonment for any term of years or for life.”.
(i) Material Constituting or Containing Child Pornography.—Section 2252A(b) of title 18, United States Code, is amended to read as follows:
“(b) Whoever violates, or attempts or conspires to violate, subsection (a) shall be fined under this title and punished by death or imprisonment for any term of years or for life.”.
(j) Coercion and Enticement.—Section 2422(b) of title 18, United States Code, is amended by striking “shall be fined under this title and imprisoned not less than 10 years or for life” and inserting “shall be fined under this title and punished by death or imprisonment for not less than 10 years or for life”.
(k) Transportation of Minors.—Section 2423(a) of title 18, United States Code, is amended by striking “shall be fined under this title and imprisoned not less than 10 years or for life” and inserting “shall be fined under this title and punished by death or imprisonment for not less than 10 years or for life”. <all>
