Susan E. Lukas 9/11 Servicemember Fairness Act

To establish a presumption of service connection for certain diseases associated with exposure to certain toxins at the Pentagon Reservation during certain period beginning on September 11, 2001.

Introduced Sep 11, 2025

Latest action (Mar 26, 2026) Forwarded by Subcommittee to Full Committee by Voice Vote.

Summary

The bill establishes a presumption that certain diseases occurring in veterans who were stationed at the Pentagon Reservation between September 11, 2001, and November 19, 2001, were service-connected and caused by exposure to toxins at that location. The covered diseases include asthma, chronic obstructive pulmonary disease, emphysema, tracheomalacia, cancer of any type, cardiovascular disease, skin disease, and respiratory disease, as well as any other condition the Secretary of Veterans Affairs determines has a positive association with identified toxins or hazards. Under this presumption, affected veterans would be eligible for VA benefits related to these conditions without needing to prove a direct connection between their service and their illness. The presumption applies to veterans who performed active duty at the Pentagon Reservation during the specified 70-day period following the September 11 attacks. Existing rules regarding VA benefits and service connection limitations would continue to apply.
