Summary

The bill treats full-time National Guard duty performed in direct support of Federal law enforcement operations as service in response to a national emergency for the purpose of eligibility for military and veterans benefits. This treatment applies to National Guard duty authorized by the President or Secretary of Defense in support of agencies including U.S. Immigration and Customs Enforcement, the Drug Enforcement Administration, and the Bureau of Alcohol, Tobacco, Firearms and Explosives, when performed to address significant criminal activity, drug trafficking, organized crime, or other public safety threats. Such service is deemed qualifying for retirement age reduction, the Transitional Assistance Management Program, Post-9/11 GI Bill benefits, and any other Federal benefits that require service in response to a national emergency. The bill does not affect the President's authority to declare a national emergency.
