To amend the Family and Medical Leave Act of 1993 to reduce the qualifying time for a spouse of an active duty member of the Armed Forces to take leave.
To amend the Family and Medical Leave Act of 1993 to reduce the qualifying time for a spouse of an active duty member of the Armed Forces to take leave.
Summary
This bill amends the Family and Medical Leave Act of 1993 to reduce the employment duration requirement for spouses of active duty Armed Forces members who need to take family and medical leave. Under current law, employees must generally be employed for 12 months before qualifying for FMLA leave; this bill creates a special provision allowing spouses of active duty service members to qualify for leave after only 90 calendar days of employment with their employer. The reduced qualifying period is intended to provide flexibility for military spouses who may need to take leave related to their spouse's active duty service.
