EBSA Investigations Transparency Act

H. R. 2869 To amend the Employee Retirement Income Security Act of 1974 to require that the Employee Benefit Security Administration make an annual report to Congress on investigations.

Introduced Apr 10, 2025

Latest action (Feb 10, 2026) Placed on the Union Calendar, Calendar No. 418.

Summary

This bill requires the Employee Benefit Security Administration (EBSA), part of the Department of Labor, to submit an annual report to Congress on its investigations into employee benefit plans and fiduciaries. The report must detail each active investigation, including which EBSA office opened it, when it was opened, and when the Secretary first requested documents. For each investigation, the report must indicate whether it was concluded within 36 months of the initial document request, and if not, explain why and provide an estimated completion date. The report protects privacy by excluding the names of companies, plan sponsors, fiduciaries, service providers, and individuals involved in the investigations. An investigation is considered concluded when the EBSA stops asserting investigative authority and terminates any compliance monitoring, as documented in a closing letter.
