To terminate the exemption from numerical limitations for H-1B nonimmigrants employed by institutions of higher education.
Summary
This bill eliminates the current exemption that allows institutions of higher education to hire H-1B visa workers without counting against the annual numerical cap. Currently, colleges and universities can employ H-1B nonimmigrant workers in unlimited numbers, while other employers are subject to an annual cap of 65,000 visas plus an additional 20,000 for advanced degree holders. Under this bill, higher education institutions would be subject to the same numerical limitations as other employers when hiring H-1B workers. The change is implemented by amending Section 214(g)(5) of the Immigration and Nationality Act to remove the subparagraph that exempts higher education from the H-1B visa cap. The effect would be that colleges and universities would have to compete with other employers for a limited pool of H-1B visa allocations each year.
