A BILL
To require the Secretary of Defense to request modifications relating to certain permits issued under the Federal Water Pollution Control Act, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the “Department of Defense PFAS Discharge Prevention Act”.
SEC. 2. STORMWATER DISCHARGE PERMITS AND TESTING AT DEPARTMENT OF DEFENSE FACILITIES.
(a) Request for Modification.—Except as provided in subsection
(b), not later than one year after the date of the enactment of this Act, the Secretary of Defense shall, with respect to each permit under section 402(p) of the Federal Water Pollution Control Act (33 U.S.C. 1342(p)) that applies to a facility of the Department of Defense, request from the State that issued the permit, or the Administrator of the Environmental Protection Agency, as applicable, a modification to such permit to require—
(1) monitoring of discharges of perfluoroalkyl and polyfluoroalkyl substances not less frequently than quarterly; and
(2) implementation of appropriate best management practices or control technologies to reduce such discharges consistent with the requirements of such Act.
(b) Exceptions.—The Secretary of Defense is not required to request a modification to a permit under subsection (a) if such permit contains the elements specified under paragraphs (1) and (2) of such subsection.
(c) Funding for Monitoring and Reduction of Discharges.—Of the funds authorized to be appropriated or otherwise made available to the Secretary of Defense in each fiscal year for remediation efforts relating to perfluoroalkyl and polyfluoroalkyl substances, not less than one percent shall be obligated or expended annually to carry out activities described in paragraphs (1) and (2) of subsection (a). <all>
