Nuclear Enforcement Accountability Act of 1994

103d CONGRESS S. 1165

Introduced Jun 25, 1993

Latest action (Aug 11, 1994) Placed on Senate Legislative Calendar under General Orders. Calendar No. 555.

Summary

This bill amends the Atomic Energy Act to authorize any person to petition the Nuclear Regulatory Commission to institute enforcement proceedings to modify, suspend, or revoke a nuclear license, or to take other appropriate action. The NRC must grant a petition if the petitioner demonstrates material evidence that the license holder is in significant noncompliance with license terms, applicable law, or NRC regulations, or that the licensed activities present a substantial hazard to public health and safety or common defense and security. Any NRC decision denying an enforcement petition becomes subject to judicial review under federal administrative law, and courts may award damages and costs if an appeal is found to be frivolous.
