Student Borrower Bankruptcy Relief Act of 2022

To provide bankruptcy relief for student borrowers.

Introduced Sep 30, 2022

Latest action (Nov 1, 2022) Referred to the Subcommittee on Antitrust, Commercial, and Administrative Law.

Summary

This bill amends the bankruptcy code to allow student loan debt to be discharged in bankruptcy proceedings. Currently, federal law generally prohibits the discharge of student loans except in cases of undue hardship; this bill removes that exception. By striking the provision that makes student loans non-dischargeable, the bill enables borrowers to include federal student loans in bankruptcy cases filed on or after the date of enactment. The amendments apply only to bankruptcy cases commenced after the bill becomes law.
