A BILL
To amend title XVIII of the Social Security Act to impose limitations on contracts with Medicare Advantage organizations offering multiple Medicare Advantage plans under the Medicare program.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. IMPOSING LIMITATIONS ON CONTRACTS WITH MA ORGANIZATIONS OFFERING MULTIPLE MA PLANS UNDER MEDICARE.
Section 1857 of the Social Security Act (42 U.S.C. 1395w-27) is amended by adding at the end the following new subsection:
“(j) Limitations on Contracts With MA Organizations Offering Multiple MA Plans.—With respect to contracts entered into or renewed on or after the date that is 1 year after the date of the enactment of this subsection—
“(1) the Secretary may not enter into or renew 1 or more contracts with an MA organization under this section with respect to more than 3 MA plans offered for a plan year by such organization under this part; and
“(2) the Secretary may not enter into or renew 1 or more contracts with an MA organization under this section with respect to more than 1 MA plan offered for a plan year by such organization under this part unless each such MA plan is significantly different with respect to premiums, benefits, or cost-sharing structure (as determined by the Secretary).”. <all>
