Mr. Finstad introduced the following bill; which was referred to the Committee on Energy and Commerce

A BILL

To amend title XIX of the Social Security Act to allow for Federal financial participation for services furnished to patients in an institution for mental diseases under the Medicaid program.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the “Restoring Inpatient Mental Health Access Act of 2025”.

SEC. 2. ALLOWING FOR FEDERAL FINANCIAL PARTICIPATION FOR SERVICES FURNISHED TO PATIENTS IN AN INSTITUTION FOR MENTAL DISEASES UNDER THE MEDICAID PROGRAM.

(a) In General.—Section 1905(a) of the Social Security Act (42 U.S.C. 1396d(a)) is amended—

(1) in paragraph (1), by striking “(other than services in an institution for mental diseases)”;

(2) in paragraph (4)(A), by striking “(other than services in an institution for mental diseases)”;

(3) by striking paragraph (14);

(4) in paragraph (15), by striking “(other than services in an institution for mental diseases)”; and

(5) in the matter designated as subparagraph (B) following the last numbered paragraph of such subsection, by inserting “furnished before January 1, 2027,” after “care or services”.

(b) Conforming Amendment.—Section 1915(l)(1) of the Social Security Act (42 U.S.C. 1396n(l)(1)) is amended by inserting “and before January 1, 2027,” after “October 1, 2019,”.

(c) Effective Date.—The amendments made by this section shall apply with respect to medical assistance furnished on or after January 1, 2027. <all>
