IN THE HOUSE OF REPRESENTATIVES

Mr. Thomas of California introduced the following bill; which was referred to the Committee on Natural Resources

A BILL

To amend the Central Valley Project Improvement Act to prohibit the restoration of certain flows in the San Joaquin River.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SAN JOAQUIN RIVER.

(a) Releases.—

(1) Prohibition.—The Secretary of the Interior may not make releases for the restoration of flows between Gravelly Ford and the Mendota Pool on the San Joaquin River as a measure to implement the Central Valley Project Improvement Act (106 Stat. 4706) without a specific Act of Congress authorizing such releases.

(2) Repeal of requirements.—Section 3406(c) of the Central Valley Project Improvement Act (106 Stat. 4721) is amended—

(A) by striking out “1996:” and all that follows through “(2) in the course of” and inserting in lieu thereof “1996, in the course of”; and

(B) by striking out “and those of the San Joaquin River under paragraph (1) of this subsection”.

(b) Technical and Conforming Amendments.—

(1) Renewal of existing long-term contracts.—(A) Section 3404(c)(1) of the Central Valley Project Improvement Act (106 Stat. 4708) is amended by striking out “section 3406(c) and”.

(B) Any provision in a contract that is subject to section 3404(c)(1) of such Act that refers to payment of the charge mandated in section 3406(c) of such Act, as such sections were in effect on the day before the date of the enactment of this Act, shall be null and void.

(2) Restoration activities.—Section 3406(b)(1) of such Act (106 Stat. 4714) is amended by striking out “Pool, for which a separate program is authorized under subsection 3406(c) of this title;” and inserting in lieu thereof “Pool;”.

(3) Section heading.—Section 3406(c) of such Act (106 Stat. 4721) is amended by striking “San Joaquin and Stanislaus Rivers” and inserting in lieu thereof “Stanislaus River”.

(4) Restoration fund.—Section 3407 of such Act (106 Stat. 4727) is amended—

(A) in subsection (a), by striking out “3406(c)(1)”; and

(B) in subsection (c)(1), by striking out “3405(f), and 3406(c)(1)” and inserting in lieu thereof “and 3405(f)”. <all>
