Brownfields Broadband Deployment Act
To provide that a project for the deployment or modification of a communications facility entirely within a brownfield site is not subject to requirements to prepare certain environmental or historical preservation reviews.
Summary
This bill exempts projects to deploy or modify communications facilities on brownfield sites from certain environmental and historical preservation review requirements. Specifically, the bill provides that such projects are not subject to the National Environmental Policy Act (NEPA) or National Historic Preservation Act (NHPA) when the project is located entirely within a brownfield site and requires Federal Communications Commission authorization. The exemptions mean these projects would not be considered major Federal actions under NEPA or undertakings under NHPA, which normally require environmental assessments and historical preservation reviews. Brownfield sites are defined under the Comprehensive Environmental Response, Compensation, and Liability Act as properties where hazardous substances have been disposed of or released.
