Mr. Mast introduced the following bill; which was referred to the Committee on Veterans’ Affairs
A BILL
To amend the Servicemembers Civil Relief Act to preempt any squatter’s rights established by State law regarding real property owned by a member of the uniformed services.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the “Service Member Residence Protection Act”.
SEC. 2. SERVICEMEMBERS CIVIL RELIEF ACT: PREEMPTION OF SQUATTERS’ RIGHTS.
(a) Preemption.—The Servicemembers Civil Relief Act (54 Stat. 1178; 50 U.S.C. 3901 et seq.) is amended by inserting, after section 301, the following new section:
“SEC. 301A. PREEMPTION OF SQUATTER’S RIGHTS.
“Any State law establishing squatter’s rights shall not apply to premises—
“(1) owned by a servicemember; and
“(2) occupied by a squatter during a period of military service of such servicemember.”.
(b) Clerical Amendment.—The table of contents in section 1(b) of such Act (50 U.S.C. 3901(b)) is amended by inserting after the item relating to section 301 the following new item:
“301A. Preemption of squatter’s rights.”. <all>
