Summary
This bill amends New York's Civil Practice Law and Rules to prohibit judgments by confession for consumer debts and for debts with a principal amount less than $5,000,000. A judgment by confession is normally entered without a court action based on the defendant's affidavit. The bill prevents such judgments from being entered on debts incurred by individuals for personal, family, household, consumer, or non-business purposes, as well as on any debt originally less than $5 million. The bill takes effect immediately and applies to judgments by confession entered after the effective date.
