Summary

Amend KRS 278.220 to allow an electric utility to amortize a regulatory asset without approval from the commission to defer recovery of expenses for coal, natural gas, or replacement power if the deferral lowers customer bills; require the amortization of the expense to be no more than 12 months from the date the regulatory asset is established; require the electric utility to inform the commission when a regulatory asset is established and provide the reason for its creation and accounting for the asset; allow overages or under-recovery to be placed on customer bills through refund or additional charge at the time of the electric utility's next rate case or 2-year review of the fuel adjustment clause.
