Summary
This bill prohibits individuals and entities convicted of solid waste pollution violations from procuring public contracts related to solid waste removal and disposal in New York. Penalties vary based on the severity and number of violations: felony convictions result in five-year prohibitions for first offenses, ten-year prohibitions for second offenses, and permanent prohibitions for three or more offenses. Misdemeanor convictions result in one-year prohibitions for first offenses, two-year prohibitions for second offenses, and five-year prohibitions for third and subsequent offenses. Additionally, anyone convicted of a solid waste pollution violation is prohibited from serving on the board of any entity engaged in solid waste removal and disposal. These prohibitions apply even if a violating entity reorganizes or incorporates as a new entity, and operate in addition to any other penalties imposed under environmental conservation law.
