AN ACT to amend the racing, pari-mutuel wagering and breeding law, in relation to prohibiting mobile sports wagering operators from provid- ing counseling, therapy, and treatment services for bettors in New York
The People of the State of New York, represented in Senate and Assem- bly, do enact as follows:
1 Section 1. Subparagraphs (xiv) and (xv) of paragraph (a) of subdivi- 2 sion 4 of section 1367-a of the racing, pari-mutuel wagering and breed- 3 ing law, as added by section 4 of part Y of chapter 59 of the laws of 4 2021, are amended to read as follows: 5 (xiv) maintain a publicly accessible internet page dedicated to 6 responsible play, a link to which must appear on the mobile sports 7 wagering operator's website and in any mobile application or electronic 8 platform on which a bettor may place wagers. The responsible play page 9 shall include: a statement of the mobile sports wagering operator's 10 policy and commitment to responsible gaming; information regarding, or 11 links to information regarding, the risks associated with gambling and 12 the potential signs of problem gaming; the availability of self-imposed 13 responsible gaming limits; a link to a problem gaming webpage maintained 14 by the office of addiction services and supports; and such other infor- 15 mation or statements as the commission may require by rule; [ and ] 16 (xv) when providing information regarding compulsive play, all links 17 and referrals for counseling, therapy or treatment services shall direct 18 account holders to the problem gambling services webpage maintained by 19 the office of addiction services and supports. The mobile sports wager- 20 ing operator shall not advertise or promote any other organization or 21 entity that provides counseling, therapy, or treatment services for 22 compulsive play. Nothing in this subparagraph shall prohibit the mobile 23 sports wagering operator from providing responsible gaming tools, 24 including deposit limits, wager limits, time limits, and voluntary self- 25 exclusion; and

1 (xvi) submit annually a problem gaming plan that was approved by the 2 commission in consultation with the office of addiction services and 3 supports that includes: the objectives of and timetables for implement- 4 ing the plan; identification of the persons responsible for implementing 5 and maintaining the plan; procedures for identifying users with 6 suspected or known problem gaming behavior; procedures for providing 7 information to users concerning problem gaming identification and 8 resources; procedures to prevent gaming by minors and self-excluded 9 persons; and such other problem gaming information as the commission may 10 require by rule. 11 § 2. This act shall take effect immediately.
