Summary

This bill establishes procedures and timelines for state agency contracts with not-for-profit corporations. The bill defines a "noncompliant state agency" as one that has failed to submit or execute renewal contracts with not-for-profit organizations within required timeframes for six months or more. Noncompliant agencies must submit monthly reports to the state comptroller describing unsubmitted contracts, reasons for delays, and timelines for completion, and post these reports publicly on their websites. Within six months of becoming noncompliant, agencies must also submit a detailed report to the comptroller, senate president, and assembly speaker describing efforts to improve their contract execution processes, with updated progress reports submitted every six months. The bill also modifies rules for written directives authorizing not-for-profit organizations to begin or continue services during contract negotiations, requiring written directives to include payment schedules and subjecting late payments to interest.
