AN ACT to amend the education law, in relation to prohibiting the use of most artificial intelligence in classrooms prior to high school
The People of the State of New York, represented in Senate and Assem- bly, do enact as follows:
1 Section 1. The education law is amended by adding a new section 115 to 2 read as follows: 3 § 115. Artificial intelligence prohibited. 1. As used in this section, 4 the term "artificial intelligence" or "AI" means any machine-based 5 system that makes decisions based on algorithms, machine learning, or 6 any form of data-driven modeling. 7 2. No artificial intelligence shall be used in classrooms in schools 8 prior to ninth grade; provided, however, AI may be used for diagnostic 9 purposes or explicit instruction interventions for students with disa- 10 bilities. The commissioner shall provide school districts with guidance 11 regarding permissible uses and best practices regarding such uses. 12 Nothing in this section shall limit the ability of teachers, administra- 13 tors, and other school personnel to use AI for administrative and plan- 14 ning purposes. 15 § 2. This act shall take effect on the first of July next succeeding 16 the date on which it shall have become a law. Effective immediately, the 17 addition, amendment and/or repeal of any rule or regulation necessary 18 for the implementation of this act on its effective date are authorized 19 to be made and completed on or before such effective date.
