Summary
Create a new section of KRS Chapter 367 to define "biometric identifier"; prohibit the capture of biometric identifiers for a commercial purpose without first informing and obtaining consent from the individual whose biometric identifier is at issue; conditionally prohibit a person from disclosing biometric identifiers; require a person to institute reasonable storage and destruction requirements of biometric identifiers; exempt voiceprint data retained by a financial institution and auto manufacturers' crash avoidance technology; and create a civil penalty enforced by the Attorney General or appropriate Commonwealth's attorney.
