SCR 1 CO Introduced
A state bill is a proposed law in a state legislature — separate from the U.S. Congress. Learn more →
Summary
This concurrent resolution establishes that local ordinances and regulations within a city or county's jurisdiction supersede conflicting state laws in specified areas. The areas include construction and development permitting, zoning and land use planning, siting of utilities and infrastructure, management of natural hazard and resource areas, and siting of major facilities such as airports, transit systems, highways, and water treatment systems. The resolution also applies local preemption to nuclear detonations and geothermal resource development for electricity production. The effect is to grant local governments authority to enact and enforce local laws in these designated areas even when they conflict with state law. This applies within the territorial limits and jurisdiction of each local government that enacts relevant ordinances or regulations.
