AN ACT to amend the agriculture and markets law, in relation to micro- chipping of certain animals

The People of the State of New York, represented in Senate and Assem- bly, do enact as follows:

1 Section 1. The agriculture and markets law is amended by adding a new 2 section 387 to read as follows: 3 § 387. Microchipping of certain animals. Any duly incorporated society 4 for the prevention of cruelty to animals, duly incorporated humane soci- 5 ety, duly incorporated animal protective association or other duly 6 incorporated animal adoption or animal rescue organization or municipal 7 shelter dedicated to the care of unwanted animals which makes such 8 animals available for adoption whether or not a fee for such adoption is 9 charged that is exempt from taxes pursuant to paragraph (3) of 10 subsection (c) of section 501 of the federal Internal Revenue Code, 26 11 U.S.C. 501, or any subsequent corresponding sections of the federal 12 Internal Revenue Code, as from time to time amended, that is registered 13 with the department may implant or cause to be implanted a microchip in 14 any dog or cat in the possession of such organization unless such animal 15 is determined to have an existing microchip. Such organizations shall 16 make best efforts to update the contact information associated with each 17 implanted or existing microchip, this includes: (a) identifying the 18 organization last having possession of the animal, (b) any person to 19 whom possession is transferred through adoption from such organization, 20 and (c) for lost and found animals the most accurate and updated infor- 21 mation of the current owner. 22 § 2. This act shall take effect immediately.
