AN ACT to amend the administrative code of the city of New York, in relation to prohibiting city agencies from procuring single-use water containers

The People of the State of New York, represented in Senate and Assem- bly, do enact as follows:

1 Section 1. Chapter 3 of title 6 of the administrative code of the city 2 of New York is amended by adding a new subchapter 9 to read as follows: 3 SUBCHAPTER 9 4 SINGLE-USE WATER CONTAINERS 5 § 6-319 Single-use plastic water containers. a. Definition. For the 6 purposes of this section, the term "single-use plastic water container" 7 means any sealed plastic container with a volume of less than one gallon 8 that contains flat, unflavored drinking water and is generally recog- 9 nized by the public as an item to be discarded after one use. 10 b. No agency shall enter into or renew any contract for the purchase 11 of single-use plastic water containers or meals or refreshments that 12 include single-use plastic water containers, except as provided in 13 subdivision c of this section. 14 c. The provisions of subdivision b of this section shall not apply to 15 contracts for the purchase of single-use plastic water containers or 16 meals or refreshments that include single-use plastic water containers 17 under the following circumstances: 18 (i) when necessary to protect health, safety, and welfare; 19 (ii) to prepare for or respond to an emergency; or 20 (iii) when compliance with this section would conflict with contract 21 requirements or labor agreements in existence as of the effective date 22 of this section or agreements solicited before the effective date of 23 this section. 24 § 2. This act shall take effect immediately.
