AN ACT to amend the education law, in relation to required training for school district officials

The People of the State of New York, represented in Senate and Assem- bly, do enact as follows:

1 Section 1. Subdivisions 1 and 3 of section 2102-a of the education 2 law, as amended by chapter 388 of the laws of 2010, are amended to read 3 as follows: 4 1. a. Every trustee or voting member of a board of education of a 5 school district or a board of cooperative educational services, elected 6 or appointed [ for a term beginning on or after July first, two thousand 7 five ], shall[ , within the first year of his or her term, ] complete a 8 minimum of six hours of training per term on the financial oversight, 9 accountability and fiduciary responsibilities of a school board member. 10 Such training shall be completed within the first year of each term to 11 which the member is elected. 12 b. In addition to the training required by paragraph a of this subdi- 13 vision, every trustee or voting member of a board of education of a 14 school district or a board of cooperative educational services, elected 15 or appointed [ for a first term beginning on or after the first of July 16 next succeeding the effective date of this paragraph ], shall, within the 17 first year of [ his or her ] their term, complete a training course to 18 acquaint [ him or her ] them with the powers, functions and duties of 19 boards of education, as well as the powers and duties of other governing 20 and administrative authorities affecting public education. 21 [ c. Upon demonstration of compliance, no trustee or member of a board 22 of education or a board of cooperative educational services shall be 23 required to repeat the training requirements provided for in paragraphs 24 a and b of this subdivision. Nothing in this section shall be deemed to 25 require a member of a central high school district board or a member of 26 a board of cooperative educational services to complete such require- 27 ments if such member has already completed such requirements as a member 28 of a board of a component school district. 1 be deemed to require trustees or voting members of a board of education 2 of a school district or a board of cooperative educational services to 3 complete the requirements of paragraph b of this subdivision if such 4 trustee or member is seated or appointed on or before the effective date 5 of the chapter of the laws of two thousand ten that amended this subdi- 6 vision. ] 7 3. Each trustee or member shall demonstrate compliance with these 8 requirements by filing with the district clerk a certificate of 9 completion with a sworn statement of completion of such course or cours- 10 es issued by the provider. Failure to comply with the provisions of this 11 subdivision shall disqualify such trustee or member from holding such 12 office. Actual and necessary expenses incurred by a trustee or member in 13 complying with the foregoing requirements shall be a charge against the 14 school district. 15 § 2. This act shall take effect on the first day of July next succeed- 16 ing the date on which it shall have become a law.
