AN ACT to amend the alcoholic beverage control law, in relation to an exemption for certain property from the prohibition of alcohol sales within a certain distance from a church
The People of the State of New York, represented in Senate and Assem- bly, do enact as follows:
1 Section 1. Subdivision 7 of section 64 of the alcoholic beverage 2 control law is amended by adding a new paragraph (e-18) to read as 3 follows: 4 (e-18) Notwithstanding the provisions of paragraph (a) of this subdi- 5 vision, the authority may issue a retail license for on-premises 6 consumption for a premises which shall be located within two hundred 7 feet of a building occupied exclusively as a school, church, synagogue 8 or other place of worship, provided such premises constitutes a premises 9 for the sale of food or beverages at retail for consumption on the prem- 10 ises located wholly within the boundaries of the county of New York, 11 bounded and described as follows: 12 All that certain piece or parcel of land, situate, lying and being in 13 the Borough of Manhattan, City, County and State of New York, designated 14 on the Tax Map of the City of New York, for the Borough of Manhattan, as 15 said Tax Map was on June 5, 1973 as Section 7 Block 1912 Lot 30 bounded 16 and described as follows: 17 BEGINNING at a point on the westerly side of Lenox Avenue, distant 20 18 feet Northerly from the corner formed by the intersection of the North- 19 erly line of West 127th Street with the Westerly line of Lenox (formerly 20 Sixth) Avenue; 21 RUNNING THENCE Northerly along the Westerly line of Lenox Avenue, 20 22 feet; 23 THENCE Westerly parallel with West 127th Street and part of the 24 distance through a party wall, 100 feet; 25 THENCE and Southerly parallel with Lenox Avenue, 20 feet; 26 THENCE Easterly, 100 feet to the Westerly side of Lenox Avenue the 27 point and place of BEGINNING. 28 § 2. This act shall take effect immediately.
