AN ACT to amend the social services law, in relation to increasing the federal poverty level requirement for recipients of social services where it concerns the one-time disregard of earned income following job entry for up to six consecutive months
The People of the State of New York, represented in Senate and Assem- bly, do enact as follows:
1 Section 1. Subparagraph (xiii) of paragraph (a) of subdivision 8 of 2 section 131-a of the social services law, as added by section 2 of part 3 X of chapter 56 of the laws of 2023, is amended to read as follows: 4 (xiii) once during the lifetime of a recipient of public assistance, 5 all of the earned income of such recipient will be disregarded following 6 job entry, provided that such exemption of income for purposes of public 7 assistance eligibility shall be for no more than six consecutive months 8 from the initial date of obtaining such employment and that the recipi- 9 ent's total income shall not be more than [ two ] four hundred percent of 10 the federal poverty level. In the event a recipient moves from one to 11 another social services district, this disregard shall follow the recip- 12 ient. The commissioner shall seek any federal waiver necessary to 13 effectuate the one-time earned income disregard pursuant to this subdi- 14 vision. 15 § 2. This act shall take effect immediately.
