AN ACT to amend the judiciary law, the New York city civil court act, and the uniform city court act, in relation to increasing the salaries of judges

The People of the State of New York, represented in Senate and Assem- bly, do enact as follows:

1 Section 1. Section 221 of the judiciary law, as added by chapter 630 2 of the laws of 1998, is amended to read as follows: 3 § 221. Salary of judges of the court of appeals. The annual salaries 4 of the chief judge and associate judges of the court of appeals shall be 5 as follows:

6 Chief Judge [ 156,000 ] 271,000 7 Associate Judge [ 151,200 ] 262,700 8 § 2. Section 221-a of the judiciary law, as added by chapter 630 of 9 the laws of 1998, is amended to read as follows: 10 § 221-a. Salary of justices of the appellate divisions of supreme 11 court. The annual salaries of the presiding justices and associate 12 justices of the appellate divisions of the supreme court shall be as 13 follows:

1 § 221-bb. Additional compensation of justices of the supreme court; 2 service in appellate term. A justice of the supreme court who shall be 3 designated by the appellate division of the supreme court to serve in an 4 appellate term in the manner provided in section eight of article six of 5 the constitution shall receive, in addition to [ his or her ] their judi- 6 cial salary as established by law, the sum of [ three ] five thousand four 7 hundred dollars annually as compensation for [ his or her ] their services 8 in appellate term. The presiding justice shall receive, in addition to 9 all other compensation, including for their services in the appellate 10 term, the sum of five thousand two hundred dollars annually as compen- 11 sation for their services as a presiding justice. 12 § 5. Section 221-c of the judiciary law, as added by chapter 630 of 13 the laws of 1998, is amended to read as follows: 14 § 221-c. Salary of judges of the court of claims. Section 223 of the judiciary law, as added by chapter 630 of the 24 laws of 1998, is amended to read as follows: 25 § 223. Compensation of deputy chief administrators of the courts and 26 deputy or assistant administrative judges. (a) A judge who is designated 27 the deputy chief administrator of the courts for the city of New York, 28 and a judge who is designated the deputy chief administrator of the 29 courts outside the city of New York shall each receive an annual salary 30 equal to the annual salary paid to an associate justice of the appellate 31 division of the supreme court. 32 (b) A judge who is designated a deputy or assistant administrative 33 judge within the city of New York and a judge who is designated an 34 administrative judge for a judicial district or county outside the city 35 of New York shall receive, in addition to [ his or her ] such judge's 36 judicial salary, the sum of [ four ] eight thousand [ eight ] six hundred 37 dollars annually as compensation for [ his or her ] such judge's services 38 as an administrative judge[ ; except that the presiding judge of an 39 appellate term shall receive, in addition to all other compensation, the 40 sum of three thousand dollars annually as compensation for his or her 41 services as an administrative judge ]. 42 § 13. Subdivision (f) of section 110 of the New York city civil court 43 act, as amended by chapter 725 of the laws of 2021, is amended to read 44 as follows: 45 (f) The housing judges shall be appointed by the administrative judge 46 from a list of persons selected annually as qualified by training, 47 interest, experience, judicial temperament, ability to handle a caseload 48 involving self-represented litigants and knowledge of federal, state and 49 local housing laws and programs by the advisory council for the housing 50 part. The list of persons who have been approved by such advisory coun- 51 cil, whether or not appointed to such judicial position, shall be deemed 52 public information and be published in the city record immediately after 53 such list is submitted to the administrative judge. The annual salary 54 of a housing judge shall be [ one ] two hundred [ fifteen ] twenty thousand 55 [ four ] eight hundred dollars.

Subdivision (d) of section 2104 of the uniform city court act, 2 as amended by chapter 330 of the laws of 2020, is amended to read as 3 follows: 4 (d) The number of judges of the city court in each city shall be as 5 provided herein. Full-time judgeships are specifically so designated, 6 all others are part-time: 7 Par. Nothing in this act shall be construed to supplant or overrule 14 any recommendation made by the commission operating pursuant to part E 15 of chapter 60 of the laws of 2015. This act is intended to codify the 16 recommendations made by such commission and to update the laws relevant 17 to judicial salaries in advance of the commission making recommendations 18 in 2028. In the event of a conflict between an existing recommendation 19 of that commission and this act, such recommendation shall govern such 20 conflict. Any conflict shall be construed narrowly to give effect to 21 the recommendations of the commission, followed by the specific language 22 of this act. 23 § 16. This act shall take effect April 1, 2026.
