Summary
Amend KRS 161.120 to require the Education Professional Standards Board to promulgate administrative regulations that establish the process and procedures for receiving and processing a complaint against a certificate holder; establish a specific timeline; establish specific action the board may take; require confirmation of receipt of responses or correspondences to the board from a certificate holder; require the board to provide confirmation of receipt to superintendents who submit a report to the board and provide specific notices; establish a specific timeline for a hearing for admonishment, remove the option for a hearing to be conducted by the board or a panel of three members of the board; require that the hearing provide all the due process rights afforded under KRS Chapter 13B; allow an appeal of a final order of the board to be filed in the Circuit Court of the county in which the certificate holder resides; RETROACTIVE to pending complaints filed with the board; EMERGENCY.
