AN ACT authorizing the city of Buffalo to alienate and discontinue the use of certain parklands

The People of the State of New York, represented in Senate and Assem- bly, do enact as follows:

1 Section 1. Subject to the provisions of this act, the city of Buffalo, 2 in the county of Erie, is hereby authorized, acting by and through its 3 legislative body, and upon such terms and conditions as determined by 4 such body, to discontinue the use as parkland and alienate the lands 5 described in section three of this act, for the purpose of the 6 construction, operation, maintenance, and repair of a utility thermal 7 energy network project. 8 § 2. The authorization contained in section one of this act shall only 9 be effective on the condition that the city of Buffalo dedicates an 10 amount equal to or greater than the fair market value of the parklands 11 being discontinued towards the acquisition of new parklands and/or capi- 12 tal improvements to existing park and recreational facilities. 13 § 3. The parklands authorized by section one of this act to be discon- 14 tinued as parkland is described as follows: 15 ALL THAT TRACT OR PARCEL OF LAND, situate in the city of Buffalo, 16 county of Erie and State of New York being more particularly bounded and 17 described as follows: 18 BEGINNING at a point at the intersection of the southerly line of 19 Seventh Street (66 feet wide) and the westerly line of New Seventh 20 Street (66 feet wide), said point also being the northeasterly corner of 21 lands conveyed to the City of Buffalo as recorded in the Erie County 22 Clerk's Office in Liber 11327 of Deeds at page 3650; 23 THENCE N 34° 27' 26" W along the southwesterly line of Seventh Street, 24 a distance of 130.14 feet to the northeasterly corner of lands conveyed 25 to Harbor Preservation Housing Development Fund Company, Inc. as 26 recorded in the Erie County Clerk's Office in Liber 11175 of Deeds at 27 page 1302;

1 THENCE S 16° 32' 34" W along a southeasterly line of said lands of 2 Harbor Preservation Housing Development Fund Company, Inc., a distance 3 of 192.00 feet to an angle point in said southeasterly line of lands of 4 Harbor Preservation Housing Development Fund Company, Inc.; 5 THENCE S 55° 32' 34" W along a southeasterly line of said lands of 6 Harbor Preservation Housing Development Fund Company, Inc., a distance 7 of 49.95 feet; 8 THENCE S 18° 01' 42" W through said lands of the City of Buffalo, a 9 distance of 253.06 feet to the Northerly line of lands conveyed to the 10 City of Buffalo as recorded in the Erie County Clerk's Office in Liber 11 11108 of Deeds at page 9287; 12 THENCE S 75° 58' 37" E along the said northerly line of lands of the 13 City of Buffalo and along the northerly line of lands conveyed to 257 W. 14 Genesee LLC as recorded in the Erie County Clerk's Office in Liber 11108 15 of Deeds at page 9335, a distance of 90.00; 16 THENCE N 14° 00' 35" E a distance of 88.89 feet; 17 THENCE N 88° 44' 07" E a distance of 71.15 feet to the westerly line 18 of New Seventh Street (66 feet wide); 19 THENCE N 13° 38' 07" E along the westerly line of New Seventh Street, 20 a distance of 269.39 feet to the POINT OF BEGINNING, containing 1.17 21 acres of land, more or less. 22 The described property having an area of 50,940 square feet or 1.17 23 acres. 24 § 4. Upon completion of construction of the utility thermal energy 25 network project, National Fuel Gas Distribution Corporation shall 26 restore the surface of the lands and the lands shall continue to be used 27 primarily for park purposes. 28 § 5. This act shall take effect immediately.
