Summary
This bill permits New York courts to award punitive damages against the estates of deceased individuals in civil sexual abuse cases. The bill allows punitive damages to be sought in civil actions for sexual abuse, sexual assault, sexual misconduct, sex trafficking, or any sexual conduct constituting a crime under state or federal law. Punitive damages may be awarded against the personal representative of an estate when the deceased individual committed, directed, enabled, or facilitated the underlying conduct. The standard of proof for punitive damages is preponderance of the evidence, a lower standard than criminal liability. The bill applies immediately to all pending and future civil actions, allowing victims to pursue punitive damages against estates of deceased perpetrators.
