AN ACT to amend the general business law, in relation to requiring mini- mum standards for large frontier developer's frontier AI frameworks
The People of the State of New York, represented in Senate and Assem- bly, do enact as follows:
1 Section 1. The general business law is amended by adding a new section 2 1430 to read as follows: 3 § 1430. Minimum standards. 1. The office shall adopt regulations no 4 later than July first, two thousand twenty-eight pursuant to article two 5 of the state administrative procedure act to require large frontier 6 developers' frontier AI frameworks to meet minimum standards in order to 7 prevent unreasonable levels of catastrophic risk. 8 2. In developing regulations pursuant to this section, the office 9 shall consider industry best practices, national and international stan- 10 dards, and laws and regulations in other states and jurisdictions. 11 3. The office shall solicit feedback from academia, the Empire AI 12 research institute established under section three hundred sixty-one of 13 the economic development law, the attorney general, members of civil 14 society, frontier model developers, and foundation model developers in 15 drafting such regulations. 16 4. The office shall review the regulations promulgated under this 17 section on an annual basis. Where the office deems necessary, the office 18 shall update such regulations to account for changes in scientific 19 understanding of catastrophic risk, technical advancements in frontier 20 models, critical safety incidents that have occurred, and/or identified 21 gaps in existing regulations. 22 § 2. This act shall take effect on the thirtieth day after it shall 23 have become a law; provided, however, that if article 44-B of the gener- 24 al business law, as added by chapter 96 of the laws of 2026, shall not 25 have taken effect on or before such date then this act shall take effect 26 thirty days after such article takes effect.
