AN ACT to amend the public health law, in relation to the offices and departments that the department of health shall consult with for the traumatic brain injury program and to the designation of certain persons or their designees to the traumatic brain injury services coordinating council
The People of the State of New York, represented in Senate and Assem- bly, do enact as follows:
1 Section 1. Section 2740 of the public health law, as amended by chap- 2 ter 672 of the laws of 2019, is amended to read as follows: 3 § 2740. Traumatic brain injury program. The department shall have the 4 central responsibility for administering the provisions of this article 5 and otherwise coordinating the state's policies with respect to traumat- 6 ic brain injury, in consultation with the office for people with devel- 7 opmental disabilities, the office of mental health, the department of 8 education, the office of [ alcoholism and substance abuse services ] 9 addiction services and supports , the department of social services, the 10 office for the prevention of domestic violence, the department of veter- 11 ans' services, the office of the advocate for the disabled and the 12 commission on quality of care for the mentally disabled. 13 § 2. Subdivision 1 of section 2744 of the public health law, as 14 amended by chapter 672 of the laws of 2019, is amended to read as 15 follows: 16 1. The traumatic brain injury services coordinating council is hereby 17 established and shall consist of the following persons or their desig- 18 nees: the commissioner, the commissioner of the office for people with 19 developmental disabilities, the office of mental health, the commission- 20 er of education, the commissioner of [ alcoholism and substance abuse 21 services ] addiction services and supports , the commissioner of social 22 services, the state advocate for the disabled , the executive director of 23 the office for the prevention of domestic violence, the commissioner of 24 the department of veterans' services, and the commission on quality of

1 care for the mentally disabled. In addition, the council shall consist 2 of the following persons: five persons appointed by the governor, three 3 of whom shall be persons with traumatic brain injury and two of whom 4 shall be representative of the public and have a demonstrated expertise 5 and interest in traumatic brain injury; two persons appointed by the 6 temporary president of the senate, one of whom shall be a person with 7 traumatic brain injury and one of whom shall be representative of the 8 public and have a demonstrated expertise and interest in traumatic brain 9 injury; two persons appointed by the speaker of the assembly, one of 10 whom shall be a person with traumatic brain injury and one of whom shall 11 be representative of the public and have a demonstrated expertise and 12 interest in traumatic brain injury, one person appointed by the minority 13 leader of the senate who shall be a person with traumatic brain injury 14 or be representative of the public and have a demonstrated expertise and 15 interest in traumatic brain injury; and one person appointed by the 16 minority leader of the assembly who shall be a person with traumatic 17 brain injury or be representative of the public and have a demonstrated 18 expertise and interest in traumatic brain injury. Of the five persons 19 appointed by the governor, three shall serve for a term of one year, one 20 shall serve for a term of two years and one shall serve for a term of 21 three years. Of the two persons appointed by the temporary president of 22 the senate, one shall serve for a term of two years and one shall serve 23 for a term of three years. Of the two persons appointed by the speaker 24 of the assembly, one shall serve for a term of two years and one shall 25 serve for a term of three years. The person appointed by the minority 26 leader of the senate and the person appointed by the minority leader of 27 the assembly shall serve for a term of one year. Subsequent appointments 28 for vacancies shall be for a term of three years and shall be filled in 29 the same manner as the original appointment. 30 § 3. This act shall take effect immediately.
