AN ACT to amend the executive law, in relation to the use of automatic license plate reader systems
The People of the State of New York, represented in Senate and Assem- bly, do enact as follows:
1 Section 1. Subdivision 8 of section 840 of the executive law, as added 2 by chapter 632 of the laws of 2025, is renumbered subdivision 9 and a 3 new subdivision 10 is added to read as follows: 4 10. The council shall, in addition: 5 (a) Develop, maintain and disseminate a minimum standards policy 6 governing the use of automatic license plate reader systems. The minimum 7 standards policy shall include, but not be limited to, provisions on 8 permissible uses of the automatic license plate reader technology, data 9 sharing and dissemination, prohibited uses, record retention and manage- 10 ment, and training. For purposes of this section, "automatic license 11 plate reader system" or "ALPR system" shall mean a system of one or more 12 mobile or fixed high-speed cameras used in combination with computer 13 algorithms to convert images of license plates into computer-readable 14 data. 15 (b) Recommend to the governor, rules and regulations with respect to 16 the establishment and implementation on an ongoing basis of a training 17 program for all current and new police officers regarding the policies 18 and procedures established pursuant to this subdivision, along with 19 recommendations for periodic retraining of police officers. 20 (c) Require all state and local law enforcement agencies to conspicu- 21 ously post the minimum standards for the use of automatic license plate 22 reader systems policy on such agency's website, or if such law enforce- 23 ment agency does not maintain a website, in its main office. Such policy 24 shall be made available to the public upon request. Nothing in this 25 subdivision shall prohibit any state or local law enforcement agency 26 from implementing more stringent standards for the use of automatic 27 license plate reader systems.

1 § 2. This act shall take effect one year after it shall have become a 2 law. Effective immediately, the addition, amendment and/or repeal of any 3 rule or regulation necessary for the implementation of this act on its 4 effective date are authorized to be made and completed on or before such 5 effective date.
