AN ACT authorizing Nigel Barnett to receive certain retirement service credit in the New York state and local police and fire retirement system
The People of the State of New York, represented in Senate and Assem- bly, do enact as follows:
1 Section 1. Notwithstanding any other provision of law to the contrary, 2 Nigel Barnett, a former member of the New York State and local police 3 and fire retirement system, who was employed with the division of state 4 police from May 3, 2006 through September 16, 2025, and who was a member 5 of the New York state and local employees' retirement system while 6 employed as a correction officer with the county of Dutchess, state of 7 New York, from November 18, 2002 until May 3, 2006, which service is not 8 deemed to be police service for purposes of the New York state and local 9 police and fire retirement system pursuant to section 381-b of the 10 retirement and social security law, shall be granted retirement service 11 credit pursuant to section 381-b of the retirement and social security 12 law for such employment as a correction officer with the county of 13 Dutchess, state of New York as if such service was rendered with the 14 division of state police beginning on May 3, 2006, and shall have his 15 retirement benefit recalculated, if within one year of the effective 16 date of this act, his estate representative or the superintendent shall 17 file a written request to that effect with the state comptroller. 18 § 2. In the event the beneficiary is required to make an election 19 prior to the enactment of this legislation, the pension reserve shall be 20 awarded minus any death benefit previously paid to said beneficiary. 21 § 3. All past service costs associated with the implementation of this 22 act shall be borne by the state of New York. 23 § 4. This act shall take effect immediately.
