Summary

NY S 1917 establishes an Emergency Insulin Program and corresponding trust fund to provide emergency access to affordable analog insulins for uninsured or underinsured individuals with type 1 or type 2 insulin-dependent diabetes. The program is to be established by the state health commissioner in partnership with insulin manufacturers, with large pharmacies and certain facilities required to participate by January 1, 2027. Healthcare professionals and pharmacists may prescribe and dispense analog insulins to eligible recipients under the program, with use of these medications treated as first aid or emergency treatment for liability purposes. The commissioner may establish a sliding scale cost-sharing arrangement not exceeding $100 for a 30-day supply of insulin and related supplies. An Emergency Insulin Program Trust Fund is created to support the program through state appropriations and manufacturer contributions, and the commissioner must publish findings on the program's operations within one year and biannually thereafter.
