IN THE SENATE OF THE UNITED STATES

August 6, 2026

Mr. Booker (for himself and Mr. Kim) introduced the following bill; which was read twice and referred to the Committee on Homeland Security and Governmental Affairs

A BILL

To require the Secretary of Homeland Security to cease all immigration detention operations at the Delaney Hall Detention Center in Newark, New Jersey, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the “Delaney Hall Closure Act”.

SEC. 2. DEFINITIONS.

In this Act:

(1) Department.—The term “Department” means the Department of Homeland Security.

(2) Secretary.—The term “Secretary” means the Secretary of Homeland Security.

SEC. 3. CLOSURE OF DELANEY HALL DETENTION CENTER.

(a) In General.—The Secretary—

(1) not later than 90 days after the date of the enactment of this Act, shall cease all immigration detention operations at the Delaney Hall Detention Center in Newark, New Jersey; and

(2) shall not enter into any contract or agreement to operate the Delaney Hall Detention Center in Newark, New Jersey, as a facility to detain aliens in the custody of the Secretary.

(b) Termination for Convenience.—

(1) In general.—In the Government’s interest, the Secretary shall terminate any contract for the operation of the Delaney Hall Detention Center in Newark, New Jersey.

(2) Liability.—The Department shall be liable only for payment under the payment provisions of a contract described in paragraph (1) for services rendered before the date on which the termination of such contract becomes effective. <all>
