IN THE SENATE OF THE UNITED STATES

Mr. Cornyn (for himself, Mrs. Britt, Mr. Budd, Mr. Justice, and Mr. Scott of South Carolina) introduced the following bill; which was read twice and referred to the Committee on the Judiciary

A BILL

To amend title 18, United States Code, to assert jurisdiction over murders committed by certain inadmissible or deportable aliens.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the “Justice for Victims of Illegal Alien Murders Act”.

SEC. 2. MURDERS COMMITTED BY CERTAIN INADMISSIBLE OR DEPORTABLE ALIENS.

Section 1111 of title 18, United States Code, is amended by adding at the end the following:

“(d) Within any jurisdiction of the United States (whether or not in the special maritime and territorial jurisdiction of the United States), an alien who—

“(1) is—

“(A) inadmissible under paragraph (6)(A), (6)(C), or (7) of section 212(a) of the Immigration and Nationality Act (8 U.S.C. 1182(a)); or

“(B) deportable under subparagraph (B) or (C)(i) of section 237(a)(1) of such Act (8 U.S.C. 1227(a)(1)); and

“(2) is guilty of—

“(A) murder in the first degree, shall be punished by death or by imprisonment for life; or

“(B) murder in the second degree, shall be imprisoned for any term of years or for life.”. <all>
