A BILL
To require the Secretary of Education to issue guidance regarding seizure safety in elementary schools and secondary schools, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the “Seizure Safe Schools Act of 2026”.
SEC. 2. GUIDANCE ON SEIZURE SAFETY IN SCHOOLS.
(a) In General.—Not later than 6 months after the date of enactment of this Act, the Secretary of Education, in cooperation with the Secretary of Health and Human Services, shall issue guidance on how elementary schools and secondary schools can promote seizure safety at school and safely care for students with epilepsy or other seizure disorders, including by providing such students with—
(1) services or accommodations pursuant to section 504 of the Rehabilitation Act of 1973 (29 U.S.C. 794) (commonly referred to as a “Section 504 plan”); or
(2) an individualized education program (IEP) in accordance with section 614(d) of the Individuals with Disabilities Education Act (20 U.S.C. 1414(d)).
(b) Updates.—The Secretary of Education, in coordination with the Secretary of Health and Human Services, may update the guidance issued pursuant to subsection (a) as determined necessary by the Secretary of Education.
(c) ESEA Terms.—In this section, the terms “elementary school” and “secondary school” have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801). <all>
