Defending Veterans’ Second Amendment Rights Act
To prohibit the Secretary of Veterans Affairs from transmitting certain information to the Department of Justice for use by the national instant criminal background check system.
Summary
This bill would prohibit the Department of Veterans Affairs from submitting veterans' information to the national background check system based solely on the fact that they have been determined to have a service-connected disability. Currently, some veterans with service-connected disabilities are reported to the background check system used for firearm purchases. Under this bill, the VA would be barred from making such reports on the basis of disability determination alone. The prohibition applies to veterans and other VA beneficiaries designated as having service-connected disabilities under federal law.
