Ms. Scholten introduced the following bill; which was referred to the Committee on Transportation and Infrastructure

A BILL

To require the Corps of Engineers to carry out advanced planning for dredging activities in areas with known PFAS contamination, and for other purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the “Clean Ports for Commerce Act”.

SEC. 2. PFAS ADVANCED PLANNING FOR DREDGING.

(a) Requirement.—Prior to carrying out any dredging activities in an area with respect to which the Secretary has information indicating that the dredged materials will contain perfluoroalkyl or polyfluoroalkyl substances, the Secretary shall identify—

(1) the disposal site for the dredged materials;

(2) how the Secretary will mitigate the effects of the dredging activities on water quality and public health with respect to such substances; and

(3) any potential delays in carrying out the activities related to the presence of such substances.

(b) Secretary Defined.—In this section, the term “Secretary” means the Secretary of the Army, acting through the Chief of Engineers. <all>
