Mr. Ogles (for himself, Mr. Smith of New Jersey, Mrs. Biggs of South Carolina, Mr. Stutzman, and Mr. Cloud) introduced the following bill; which was referred to the Committee on the Judiciary
A BILL
To amend title 18, United States Code, to remove criminal penalties for obstructing access to abortion services, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the “Saving FACE Act of 2026”.
SEC. 2. REMOVING CRIMINAL PENALTIES FOR OBSTRUCTING ACCESS TO ABORTION SERVICES.
(a) In General.—Section 248 of title 18, United States Code, is amended—
(1) in the section heading, by striking “clinic” and inserting “church”;
(2) in subsection (d)(4), by striking “abortions or other”; and
(3) in subsection (e)—
(A) by redesignating paragraphs (1) through (6) as paragraphs (2) through (7), respectively;
(B) by inserting before paragraph (2), as so redesignated, the following:
“(1) Abortion.—The term ‘abortion’ means the use or prescription of any instrument, drug, substance, or device—
“(A) to intentionally kill the unborn child of a woman known to be pregnant; or
“(B) to intentionally terminate the pregnancy of a woman known to be pregnant, with an intention other than—
“(i) after viability, to produce a live birth and preserve the life and health of the child born alive; or
“(ii) to remove a dead unborn child.”; and
(C) in paragraph (6), as so redesignated, by striking “relating to the human reproductive system” and all that follows through the period at the end and inserting “relating to the human reproductive system or pregnancy, excluding abortions.”.
(b) Table of Sections.—The table of sections for chapter 13 of title 18, United States Code, is amended by striking the item related to section 248 and inserting the following:
