Mr. Latta (for himself, Mr. Taylor, Mr. Barrett, and Mr. Arrington) introduced the following bill; which was referred to the Committee on Energy and Commerce

A BILL

To amend title XIX of the Social Security Act to require States to report on anti-fraud measures relating to home and community-based services furnished under the Medicaid program.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the “HCBS Anti-Fraud Reporting Act of 2026”.

SEC. 2. REQUIRING STATES TO REPORT ON ANTI-FRAUD MEASURES RELATING TO HOME AND COMMUNITY-BASED SERVICES FURNISHED UNDER THE MEDICAID PROGRAM.

Section 1915(c)(2) of the Social Security Act (42 U.S.C. 1396n(c)(2)) is amended—

(1) in subparagraph (D), by striking “and” at the end;

(2) in subparagraph (E), by striking the period and inserting “; and”; and

(3) by adding at the end the following new subparagraph:

“(F) with respect to 2026 and each subsequent year, the State will report to the Secretary on—

“(i) any waste, fraud, or abuse detected by the State relating to services furnished under such waiver; and

“(ii) efforts taken by the State to prevent such waste, fraud, and abuse.”. <all>
