A BILL
To amend the Clean Air Act to repeal the mandatory requirements for State motor vehicle inspection and maintenance programs, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the “State Emissions Authority Act of 2026”.
SEC. 2. REPEAL OF MANDATORY STATE MOTOR VEHICLE INSPECTION AND MAINTENANCE REQUIREMENTS.
The Clean Air Act (42 U.S.C. 7401 et seq.) is amended—
(1) in section 118 (42 U.S.C. 7418), by striking subsections (c) and (d);
(2) in section 182 (42 U.S.C. 7511a)—
(A) in subsection (a)(2), by striking subparagraph
(B) and redesignating subparagraph (C) as new subparagraph (B);
(B) in subsection (b)—
(i) by striking paragraph (1)(D)(iv); and
(ii) by striking paragraph (4) and redesignating paragraph (5) as new paragraph
(4);
(C) in subsection (c)—
(i) in the matter preceding paragraph (1), by striking “Except as otherwise specified in paragraph (4)” and inserting “Except as otherwise specified in paragraph (3)”; and
(ii) by striking paragraph (3) and redesignating paragraphs (4) through (10) as new paragraphs (3) through (9), respectively; and
(D) in subsection (e), by striking “paragaphs (6),
(7) and (8)” and inserting “paragraphs (5), (6), and
(7)”;
(3) in section 184(b)(1) (42 U.S.C. 7511c(b)(1)), by striking “the following” and all that follows through “implementation” and inserting “implementation”; and
(4) in section 187(a) (42 U.S.C. 7512a(a))—
(A) by striking paragraph (4);
(B) by striking paragraph (6); and
(C) by redesignating paragraphs (5) and (7) as new paragraphs (4) and (5), respectively. <all>
