Rural ER Access Act

To direct the Secretary of Health and Human Services to revise regulations to remove the requirement under the Medicare program that an off-campus facility or organization shall be located within a 35- mile radius of a hospital or critical access hospital.

Introduced Jan 28, 2025

Latest action (Jan 28, 2025) Referred to the Committee on Energy and Commerce, and in addition to the Committee on Ways and Means, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned.

Summary

This bill directs the Secretary of Health and Human Services to remove a geographic requirement from Medicare regulations. Currently, off-campus medical facilities must be located within 35 miles of a hospital to qualify for provider-based status under Medicare. The bill would eliminate this distance restriction, allowing off-campus facilities and organizations to become Medicare-eligible providers regardless of their location relative to a main hospital. The Secretary must make this regulatory change within 60 days of the bill's enactment.
