IN THE HOUSE OF REPRESENTATIVES

Mr. Moylan introduced the following bill; which was referred to the Committee on the Judiciary

A BILL

To amend the Radiation Exposure Compensation Act to include Guam.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the “Parity for Pacific Radiation Survivors Act”.

SEC. 2. ATMOSPHERIC TESTING IN THE PACIFIC.

Section 4(b)(1) of the Radiation Exposure Compensation Act (Public Law 101-426; 42 U.S.C. 2210 note) is amended—

(1) in subparagraph (A)—

(A) in the matter preceding clause (i), by striking “subparagraph (B)” and inserting “subparagraphs (B) and (C)”;

(B) in clause (ii), by striking “and” at the end; and

(C) by adding at the end the following:

“(iv) the territory of Guam;”; and

(2) by adding at the end the following:

“(C) with respect to a claim by an individual under subsection (a)(1)(A)(i)(IV) or (a)(2)(D), only Guam.”.

SEC. 3. LEUKEMIA CLAIMS RELATING TO TESTS IN THE PACIFIC.

Section 4(a)(1)(A) of the Radiation Exposure Compensation Act (Public Law 101-426; 42 U.S.C. 2210 note) is amended—

(1) in clause (i)—

(A) in subclause (III), by striking “or” at the end;

(B) by redesignating subclause (IV) as subclause

(VI); and

(C) by inserting after subclause (III) the following:

“(IV) was physically present in an affected area— “(aa) for a period of at least 1 year during the period beginning on July 1, 1946, and ending on November 6, 1992; or “(bb) for the period beginning on April 25, 1962, and ending on November 6, 1962;

“(V) was a member of the Armed Forces who participated onsite in the radiological cleanup of Enewetak Atoll for any period of time during the period beginning on May 1, 1977, and ending on May 31, 1980; or”; and

(2) in clause (ii), by striking “subclause (I), (II), or

(III) of clause (i) or onsite participation described in clause

(i)(IV)” and inserting “subclause (I), (II), (III), or (IV) of clause (i) or onsite participation described in subclause

(V) or (VI) of clause (i)”.

SEC. 4. SPECIFIED DISEASES CLAIMS RELATING TO TESTS IN THE PACIFIC.

(a) In General.—Section 4(a)(2) of the Radiation Exposure Compensation Act (Public Law 101-426; 42 U.S.C. 2210 note) is amended—

(1) in subparagraph (C), by striking “or” at the end;

(2) by redesignating subparagraph (D) as subparagraph (F); and

(3) by inserting after subparagraph (C) the following:

“(D) was physically present in an affected area—

“(i) for a period of at least 1 year during the period beginning on July 1, 1946, and ending on November 21, 1992; or

“(ii) for the period beginning on April 25, 1962, and ending on November 6, 1962;

“(E) was a member of the Armed Forces who participated onsite in the radiological cleanup of Enewetak Atoll for any period of time during the period beginning on May 1, 1977, and ending on May 31, 1980; or”.

(b) Inclusion of Renal Diseases.—Section 4(b)(2) of the Radiation Exposure Compensation Act (Public Law 101-426; 42 U.S.C. 2210 note) is amended—

(1) by inserting “renal disease,” after “lymphomas (other than Hodgkin’s disease),”; and

(2) by striking “or lung” and inserting “lung, or renal”. <all>
