A BILL
To amend the Immigration and Nationality Act to provide that an alien may request that a removal proceeding take place through video conference or through telephone conference, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the “Migrant Due Process Protection Act”.
SEC. 2. RIGHT OF AN ALIEN TO REQUEST VIRTUAL REMOVAL PROCEEDING.
Section 240(b)(2) of the Immigration and Nationality Act (8 U.S.C. 1229a(b)(2)) is amended by adding at the end the following:
“(C) Right to request virtual proceeding.—For an alien (except in the case of an alien who is in the custody of the Secretary) who requests that the proceeding take place through video conference or through telephone conference, the immigration judge shall grant such request, and shall ensure that there is no prejudice to the alien during the proceeding.”. <all>
