A BILL
To protect collective self-determination and individual rights under Federal statutes conferring nationality on persons born and residing in the territory of American Samoa, to enable subsequent elective United States citizenship upon application of such persons residing in a State or in a territory subject to sections 301 through 308 of the Immigration and Nationality Act, and for other purposes.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the “American Samoa Statutory Nationality and Citizenship Act”.
SEC. 2. RECLASSIFICATION OF UNITED STATES NATIONALS.
(a) In General.—Section 341(b) of the Immigration and Nationality Act (8 U.S.C. 1452(b)) is amended to read as follows:
“(b) A person who claims to be a national, but not a citizen, of the United States, thereby having full duties of nationality and allegiance thereto, may apply to the Secretary of State for a United States passport. Upon proof to the satisfaction of the Secretary of State that the applicant is a national, but not a citizen, of the United States, the person shall be issued—
“(1) a United States passport identifying the person as a national, but not a citizen of the United States; or
“(2) upon written and signed request in the application of such person residing in a State or in a territory subject to sections 301 through 308, a United States passport identifying that person as a national and a citizen of the United States.”.
(b) Conforming Amendments.—
(1) Section header.—Section 341 of the Immigration and Nationality Act (8 U.S.C. 1452) is amended by striking the section header and inserting the following: “PROCEDURE FOR PASSPORTS FOR U.S. NON-CITIZEN NATIONALS”.
(2) Table of contents.—The table of contents of the Immigration and Nationality Act (8 U.S.C. 1101 et seq.) is amended by striking the item relating to section 341 and inserting the following:
“Sec. 341. Procedure for passports for U.S. non-citizen nationals.”.
(c) Repeal.—Section 325 of the Immigration and Nationality Act (8 U.S.C. 1436) is repealed. <all>
