Mr. Fields introduced the following bill; which was referred to the Committee on Agriculture
A BILL
To amend the Food and Nutrition Act of 2008 to increase food access for recipients of supplemental nutrition assistance program benefits by permitting the use of benefits to pay the related cost of food delivery services.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the “Snap Delivery Modernization Act of 2025”.
SEC. 2. AMENDMENTS.
The Food and Nutrition Act of 2008 (7 U.S.C. 2011 et seq.) is amended—
(1) in section 3 by adding the following definition—
“(X) ‘Delivery platform or delivery services provider’ means an entity that—
“(1) facilitates the online-sale, or delivery, or both, of food from a retail food store; or
“(2) delivers food purchased from a retail food store, including using a first-party delivery service or contracting with a third-party to complete delivery.”.
(2) in section 3(o)(5)—
(A) in subparagraph (B)—
(i) by striking “order—” and all that follows through “(i)”, and
(ii) by striking clause (ii), and
(B) in subparagraph (C) by inserting “(excluding related fees for delivery of the food)” before the period at the end, and
(3) in section 7(k)—
(A) in subparagraph (2)(B)—
(i) by striking “delivery,”, and
(ii) by inserting “(excluding delivery fees charged by the retail food store or a delivery platform or delivery service)” after “charges”, and
(B) in subparagraph (C)(i)—
(i) by striking “delivery,”, and
(ii) by inserting “(excluding delivery fees charged by a retail food store, or a delivery platform or delivery service)” after “purchase”. <all>
